Murray wants his conviction revoked pending appeal

Murray has filed legal documents yesterday claiming he should be out of jail pending appeal as now he claims the stress killed Michael Jackson, not him.

Murray says the judge should have allowed him to prove that Jackson was so stressed out over his financial woes, he recklessly rolled the dice by self-administering a fatal dose of propofol, according to legal docs.

In  the section titled, “Financial Condition of Michael Jackson”, is said, "Mr Jackson was in debt approximately USD 440 million and desperately needed to fulfil a contractual commitment at the O2 arena in London.”

“He was on the verge of losing his entire estate to foreclosure. The pressure to fight through his insomnia, to rehearse and be the entertainer he was in his earlier years was overwhelming.”

“His motivation and resulting desperation were relevant to show a likelihood or reason to act in a manner inconsistent with good judgement.”

Michael Jackson's financial situation was excluded from the trial (as that of Murray) because both were not relevant to the case, that was focused on Murray's recklessness and negligence for administering a powerful anesthetic in home setting and without properly monitoring his patient.

Murray's baby mama, Nicole Alvarez, filed a declaration of support for Murray today in which she says if Murray is released he will live with her and their 2-year-old son in Santa Monica, Tmz reported.

Alvarez says, "Dr. Murray is the father of my child", and adds, "he has been our primary source of support."

Alvarez had sued Murray before since he did not pay child support.

Murray was found guilty of involuntary manslaughter on November 7, 2011 by all 12 jurors unanimously.

Los Angeles Superior Court Judge Michael Pastor, in sentencing him, said he is a danger to community and had harsh words to him for his numerous lies, which have also impeded to save Michael Jackson's life as he never mentioned propofol with paramedics and UCLA doctors, and for his lack of remorse and blaming the victim as he feels he did nothing wrong.

The hearing is scheduled on tomorrow, February 24.
